For anyone who doesn't know, the MOMA is the Museum of Modern Art. And for anyone who doesn't know me, modern art isn't really my thing. Manda loved it, so I indulged her, and now I never need to go back.

While modern art isn't my thing, and really art appreciation isn't really my thing (we also spent a day at the Met and that was somewhat tortuous, although much less so than the MOMA), I am able to appreciate the artistic talent of the pieces. We did the audio tour, which entails carrying around what looks like an old cell phone, into which you type numbers to hear the curators and art critics talk about pieces. I had a really hard time getting through the audio explanations, because I feel like the majority of the time the artists don't put nearly as much thought into the painting as later interpreters credit them with. In other words, I feel like the critics like to hear themselves speak, so they make up a bunch of bull to sound deep and so understanding of the tortured soul of the artist.

Anyway, just because I don't want any of the art, doesn't mean it isn't art...except the crap that isn't art. These pictures are a few examples of some of the things they had on display that cannot seriously be art. For anyone who thinks they are, the emperor is really naked, he doesn't have a new suit on.

Of all of these pictures this one is my favorite (in all seriousness) but only because it reminds me of Qbert. This is somewhat artistic, but it is just theft of the Qbert game screen

Maybe it is just my simplistic mind, but what is artistic about a rope, especially if the artist didn't even make the rope. If the artist made the rope, then maybe there is some argument, although not a strong one.

Ok, a piece of fabric stuck to the wall. There is no design on the fabric, no apparent shape to it, it is a solid color, and stuck to the wall. Seriously? Maybe the emperor should have ordered his suit in this color.

This is one of my favorites, in a sarcastic way. Its description is nylon cord and metal brackets. It is a purple nylon cord running through four metal brackets, two on the wall, two on the floor. Wow!

This may come in handy if your kids are acting up, but it is really just a very skinny steel cage.

I have moved and stacked a lot of bricks in my life, I never knew I was being artistic. There are 120 bricks here, stacked in the middle of the floor. I thought they were getting ready to display something on top of them, but no, this is supposedly art.

I think this one was my absolute favorite. I know it looks brown, but that is because I was not using the flash and I don't know how to use the camera as well as Manda so I can't get good color. It was actually black. That's it! No detail. No indentations. Nothing. It is oil on canvas, an it is solid black! What the hell?!?!

These pieces of "ART" (and I use the term loosely) somehow are deemed to be good enough to be displayed in a world renowned museum. Who are the pretentious morons who are doing this? These are being displayed in the same museum as van Gogh's Starry Night, and Warhol art work, along with many other pieces of art that I don't like, but I can at least appreciate the artistic value of them. Art is whatever you can get away with, but seriously, the emperor is naked. Get him some clothes!

The Plays

Ok, so Amanda and I went to see a couple of plays while we were in New York. The first one we saw was Mary Poppins.

It was really entertaining with great acting and singing. But the real star of the show was the scenery. It was really amazing how efficiently they could change the set without any delay in the play. The massive set pieces easily switched between the main floor of the house and the nursery, then to the rooftops. It was really a fun show to see, but nothing compared to Rock of Ages.
If you are a fan of 80s Butt Rock, you will love Rock of Ages. It even made me like Constantine Maroulis (of American Idol fame). This show features music from Whitesnake, Journey, Starship, Poison, REO Speedwagon, Europe, Bon Jovi, Foreigner, Warrant, Mr. Big, and much more. The acting isn't great, and I didn't feel that story was all that strong, but it is a lot of fun, and extremely entertaining. Be aware, however, that it is a bit risqué so the teenage kids in front of us were a little uncomfortable with their parents right behind them. All said, Rock of Ages was a ton of fun.

New York

So, Amanda and I just got back from a week in New York. Amanda's sister, Emily, and her husband, Miles, were in New York for the summer and they kindly let us stay at the apartment they sub-let, thereby drastically reducing our costs, allowing for a much more enjoyable experience.
We had a lot of fun on the trip. We went all around Manhattan on a great bus tour, well the tour was great for the first part, the down town tour. For the uptown tour we had a horrible guide who didn't know anything. On that part of the tour we learned a lot of useless facts about Holland, and the Dutch love of sprinkles.
Anyway, we also went to the Met, the Moma, to a Yankees-Red Sox game, to a couple of plays (Mary Poppins and Rock of Ages), Central Park, of course to Tiffany, too much shopping on Canal Street, we walked the Brooklyn Bridge and much, much more.
Here are some pics...

<img style="TEXT-ALIGN: center; The end has come. Today is the last official day of my law school career. I actually finished on Wednesday when I emailed my paper in, but finals end today, and the semester is officially over. One week from today I will be graduating, then it is time to start studying for the bar exam. I have actually already started studying, and it is no fun, but you only have to pass the bar once. Anyway, in the words of London Tipton, Yay me!

Twilight should have never seen the light of day!

<img style="display:block; margin:0px auto 10px; text-align:center;cursor:pointer; cursor:hand;width: 270px; height: 400px;" src="http://4.bp.blogspot.com/_ENkEGLi5L28/SdEwguBau0I/AAAAAAAAASQ/dwk6eKhgRH4/s400/twilight-movie-poster.jpg" border="0" alt=""id="BLOGGER_PHOTO_ID_5319085973569190722" />

Ok, so I can understand the book being good (I don't know, I haven't read it), but the movie was awful. Amanda convinced me to watch it over the weekend, we got it on Netflix, so I figured I wouldn't feel guilty if I just turned it off, or left the room, but I couldn't. Much like driving slowly past an accident on the freeway, when you see a white sheet over something on the ground, you can't help but look. However, in this case, it wasn't just the white sheet, it was a decapitated body with blood flowing from the gaping wound. I couldn't pull myself away.
You would think, given the success of the books, that the studio would have invested a little bit of money in the movie and produced a decent screenplay, but they didn't. The entire thing was so low budget that I couldn't help laughing to myself numerous times throughout the movie. Oh, did I mention the acting was atrocious too.
Anyway, if you are looking for a good movie to watch, steer very clear of Twilight, but if you are looking for a movie to make fun of, I would probably still steer clear of this one, but you can make a lot of fun of it.

The End Is Near!

<img style="display:block; margin:0px auto 10px; text-align:center;cursor:pointer; cursor:hand;width: 400px; height: 300px;" src="http://3.bp.blogspot.com/_ENkEGLi5L28/SckauCQLVzI/AAAAAAAAASI/psf1F9P0ETE/s400/homer.jpg" border="0" alt=""id="BLOGGER_PHOTO_ID_5316810213268608818" />

So, I got an email today from a fellow student. This email informed me that there are only about 5 weeks of classes left. I don't have any finals this semester, I just have a couple of papers (3 of them short 2-3 page papers) and a trial to do. It will be a lot of work before I am done, but the end is near. In just under two months I will have a JD, but unfortunately this is the worst time to graduate from school. No one is hiring. So, I guess it is a time for joy at being done, and a time for fear at not having a job for after graduation. Anyway, wish me luck.

CNBC Gives Financial Advice

I thought this was pretty funny.

<a href='http://www.comedycentral.com' target='_blank' style='display:inline; Of course nothing was on Food Network (or at least Alton wasn't on) so I was resigned to flip through the stations, trying to find something interesting to watch. Because of all the cable news channels, and because of all of the big networks broadcasting it, I was bombarded with Obama's speech to Congress. As I will later explain, I found myself so frustrated that I turned to the Wii and played a little World at War (which only heightened my frustration).

My frustration wasn't with Obama, but with the rest of the crowd there. Why is it that politicians can't give a speech in which most of the time involved is not used up by applause? I've gotta say, if I were President I would start my speeches by saying, "please hold your applause until the very end of my speech." Think about the time wasted by the constant pauses required to allow the annoying people to stand up and clap for 30 seconds every 15 seconds. Think how much more quickly they could get back to regularly scheduled programming if they weren't wasting all that time applauding. Think about how much more coherent the speeches would be without breaking up the speech constantly.

Oh and on a side note, how annoying were Nancy Pelosi and Joe Biden last night? Pelosi was the instigator of so much of the annoying applause, and did you guys see Joe Biden do the wink and point. What was that all about? Anyway, those are my thoughts.

Maybe next time I will discuss my grievances with video games that trap you on a level and there is nothing you can do, no one to kill (you can't even kill your own guys) and nowhere to go.

Servus.

Hope? I promise this post has nothing to do with football, or about how much better the U is than the Y.

Ok, news flash... the economy is in the crapper. The Bush administration kind of screwed us over with the so-called stimulus. It didn't do anything except bail out companies that should not have been bailed out. Darwin was right in at least one respect. Businesses that can't survive should not survive. Let a new, smaller, more efficient company take over and start anew. Don't even get me started on the auto industry, oh, too late.

The American auto industry is just about worthless, so why did we just give them billions of dollars? To delay the inevitable collapse, of course. The first thing that needs to happen with the auto industry is move them from Michigan. Either move them to a non-union state or change Michigan into a non-union state. The UAW (along with most other unions) is the devil. All unions do is create job security for workers who no longer have motivation to do a good job. Wait haven't we seen this before, oh yeah, in the USSR, it is called communism and it failed. No surprise the auto industry, hampered by the UAW, is failing. See the Chinese form of communism seems to be working somewhat because those workers still have motivation. It isn't that if you do a good job you will be promoted and earn a good living, it is that if you don't do a good job you will be thrown into a prison for the rest of your life and be tortured. That can be great motivation.

The big three auto companies should be merged into one. Get rid of the bad apples and start with a new, more efficient company called American Motors. Think of the advertising dollars that could be saved just on the trucks alone. No other company truly competes with the big three on trucks (for about a year Honda tried to, but that appears to be over, and Toyota has a nitch in the market, but the vast majority of the market is tied up in Dodge, Ford and GM). If the new company took all of the good things from each of the trucks and created a new model, without any of the bad issues, there would be multi-millions saved each year in advertising costs alone. I know, there is the slight issue of a monopoly, but we can work around that. And the issue of jobs lost by those who now work for the big three? Give them a few months to prove they deserve a job. If they don't, fire them! That's the way it works in any non-union industry, and it is the American way, isnt it?

New topic. Any company that has received any amount of bailout should be unable to give anyone in the company a bonus for at least 5 years, or until the company pays the bailout back. Also, all executives should be limited in salary to no more than $1 Million annually. Since when does anyone deserve $700 Million in salary and bonuses. I don't care who you are or what you do, that is absolutely unreasonable, especially if you are then turning to the government and requesting money so you can buy a few new jets and take everyone to Vegas for a "retreat."

Hope??? I consider myself a conservative. I'll tell ya, I even voted for McCain. (On a side note, I didn't like either of the candidates.) But I came in to this administration with hope, isn't that what we are supposed to have with Obama in the White House. So why is it that the Democrats, now that they are securely in power, are doing the exact thing they accused Republicans of doing, fearmongering? Why is it that Obama insisted on passing this new stimulus bill that almost no economist, outside the administration, believes will be effective. Isn't that just adding debt to an already bad situation? Oh yeah, if it doesn't pass now, a catastrophe will occur. Isn't that exactly the type of language Democrats hated Republicans for using? I know they are all politicians and will say what they need to, but you didn't even wait one month into the new administration to start the fearmongering, the exact thing you despised in the late administration.

Now, for anyone still reading, we are all in a bad situation. The economy sucks. Jobs are scarce. Get over yourself thinking that everyone should pity you. Everyone's situation sucks right now, so quit being so selfish and assuming that your situation is so much worse than everyone else's.

For anyone still reading (i know I used that in the last bit, but I am using it again). This has been a stream of conscience post. Sorry for any ill-thought out ideas. Sorry for any grammatical errors. Sorry for wasting your time. These are just a few thoughts I had.

Servus

<link rel='alternate' type='text/html' href='http://meiszusmusings.blogspot.com/2009/02/hope-pity-party-sorry-this-is-rant.html' title='Hope? First, "Harline is still open." Second, "It's fourth and eighteen, do you know where Austin Collie is?" or just "4th and 18." I have a question. What is the new saying? I was thinking maybe, "Hall back to pass...it's picked off! Again!"

I was talking with my brother-in-law, Daren about the game yesterday. I told him it was a good game all the way to the end of the third quarter, then it became a great game. I do have to admit, Utah has been outplayed for almost entire games throughout the season, only to come through at the end of the game. That was definitely not the case on Saturday. Utah outplayed BYU in every aspect of the game. Being plus 6 in turnover ratio tells the story of the night. The Utes manhandled the kitties to clinch a BCS bowl birth for the second time. And to top it off, assuming Utah doesn't drop in the next couple of weeks, Utah is still the only team to qualify under the old BCS rules, and this is the second time they will do it.

BYU fans, maybe next year you should get on Austin Collie's home teaching companion, and make sure they are magnifying their callings so that God will bless them to win the game.

Here are a few pics from the game.

Touchdown!

That looks like a facemask to me.

Johnson played the game of his career as he tore apart BYU's defense.

I told you he hadn't really seen a defense this year, before TCU.

Oooooo, cold! From October 28 through November 2 we went to Disneyland. Amanda and I took Spence and some of my family came too. We traveled to Anaheim with Papa, and Spence threw up 3 times on the plane; once on mom, once on the floor and once on Papa, I was lucky.

Papa left us at the gate to the park on Tuesday and the three of us went in. There was no one there and we could have basically walked on to every ride. Too bad we couldn't leave Spence. Tuesday night Jenny and her family (Steve, Abby, Tyler and Makenna) came up from San Diego, and my mom, Mindy and Jessica flew in. Wednesday we all went in together. We had a lot of fun on the trip, but for now, I am Disneyed-out.

<img id="BLOGGER_PHOTO_ID_5270037233169180578" style="DISPLAY: block; The commentators were saying, as the Utes got the ball back for the final drive, that if you had to put the ball in anyone's hands, at this stage in the game, Brian Johnson was the person you wanted to have the ball. He proved it in the Oregon State game, and he proved it again last night. TCU played a great game, and I really feel bad for their kicker, but not bad enough to wish he had made either of those field goals. Our defense really kicked it into gear after that first quarter and won the game for us by continually giving our offense chance after chance to win the game. Anyway, it was a great game, a real nail-biter (and i have the bloody fingers to prove it) and if you missed it you missed one of the best games of the year in college football.

What I really wanted to talk about were two issues with the game last night. First, what the hell is up with a referee watching a player be knocked to the ground while the ball is in the air, and not calling pass interference? I don't see how that missed call was possible. I guess you could say that the ball was uncatchable, but how could you know that with the positions they were in. You can make that call when the ball is going out of bounds and you wouldn't be able to come down with it in bounds, but in the middle of the field and the receiver is dropped to the ground while in full sprint and the ball lands within 10 yards of him, you can't say he couldn't have caught that ball. Thankfully that and the next botched PI call were not game changing.

My real beef is with the moron at the MWC who has negotiated our television deals. I have cable, basic cable, but I get the Mountain, I get Versus, I get ESPN and ESPN2; but guess what channel I don't get...CBS College Sports. Oh, not to worry, you can watch the broadcast online, but wait, it cost $20 for the one game. Why the hell can't the MWC get a half-way decent TV deal. ESPN would have killed to show that game last night. Two top 15 teams battling it out to determine who still has a shot at going to a BCS bowl. Of course they would have chosen that over Maryland and VT. Thankfully Amanda's parents have satellite and I was able to go over there and watch the second half, but seriously, our TV situation sucks. Just wait, if the same guy is working our TV deals it won't be too long before BYU-Utah is not broadcast. I say fire that jackass and get us a deal that shows most of our games. That deal should include an automatic broadcast of any game in which two top 25 teams are playing, and make it a long term deal so we know what type of television broadcast to get (satellite or cable).

Anyway, sorry for the ranting. Please feel free to call me a moron if you think that is true. But, did anyone else notice how he is already trying to weasel out of responsibilty for actually changing things. First he said that change had arrived in America. I guess that's true, we elected the first black president, but he's almost as white as McCain, so that's not real change. I want to see real change, just like he has been promising for two years. But he went on to say that it might take a long time, it might even take more than one term (he's already campaigning for 2012). But, Mr. Obama, you have no excuses for not getting things done, your party dominates both houses of Congress. So, get things done.

On a side note, does anyone else think that it is sad that the two candidates for President were McCain and Obama; how disappointing. Are there no better people out there that want to be President of the United States? Hopefully in 2012 we will have a better candidate to run against Obama.

***I was told that this post makes me sound pissed about the Presidential election. I am not pissed at all. I truly hope that Obama can make the country a better place. Much like I thought with McCain, I don't think Obama will be a great President, but I hope that I am wrong. Just don't turn us into a socialist country (I have seen first hand what socialist medicine looks like) and don't give me excuses, you have a strong majority in Congress, get things done. Good luck. I would have totally redone the post, but I don't know if all of the comments would make sense, so I left it.

Re: Anonymous Comment on BYU/TCU Post

Dear Anonymous BYU fan,

Thank you for telling me that my wife and I are the reason you hate U fans. You reinforced my hatred of BYU fans. The majority of you think that you are better than us, you are self-righteous pricks who think that because you got into BYU (assuming you did, which is very questionable) you are smarter than we, who chose to attend the U. It looks like Austin Collie must have been fasting and praying to pull out that game against Colorado State. I guess he hadn't done his home teaching before they played TCU. Here's hoping he doesn't pay his tithing before the U game, so that God won't reward him with a win because he is living his life the way God wants him to. Maybe I will fast and pray for a Utes victory so that Heavenly Father will bless us, because we all know He cares who wins the football game.

Right now all BYU fans are pissed and bitter because they lost, oh, sorry, they were completely demolished by TCU. The funny thing is, TCU needed only one thing to beat BYU, a defense. Bad news BYU, the Utes have a defense too. Our offense didn't look great against New Mexico, but as we have seen the past few weeks, BYU has no defense.

Anyway, thanks for commenting on my blog, I warmly welcome all comments, even if you are too much of a chicken to leave your name.

BCS Ranked

I know, I should leave it alone, but Tyler sent this to me and I thought it was pretty funny. Of course it would have been great to have the Y and the U both be undefeated on November 22. We would have had College Gameday back in town, there would have been huge implications for the game, not just the MWC title at stake, and it would have been a great game. However, the U has been receiving no love in the polls of late, and as a result we have no shot at making the National Championship Game, BYU had a shot, however slim.* As a result, the best the U can hope for is a trip to a BCS game (our second trip), at our current ranking and assuming we do go undefeated, we don't need BYU to be undefeated when we play them. As a result, I am absolutely ecstatic to see BYU's BCS dreams once again go down the crapper. Go Utes!!!

*As for whether a MWC team deserves to be in the National Championship Game I will reserve my tirade, but suffice it to say that as long as there is one undefeated from a real BCS conference (none of this ACC or Big East crap) and a one-loss SEC team, there is no justification for having a MWC team in the game. I don't know, but I might even think that a two loss SEC team would deserve it more, depending upon against whom those two losses were received. I'm not saying the in the future the MWC could not be justified in sending a team, but we need more seasons like this where we beat up on the BCS conferences. It needs to be consistent for us to be taken seriously.

Happy Birthday Spence!

Happy birthday Spence,

Your mom and I are so happy we have you, and couldn't imagine our lives without you. It was a lot of fun. The fans were on the whole, very polite (unlike BYU fans) even when we had won the game.
Of course the Utes decided to give us all quite a scare by giving up the majority of their 15 point lead late in the game, but the defense stepped up and was able to hold the Wolverines to win the game. The Utes made a ton of stupid mistakes, predominantly mental errors resulting in penalties, so there is plenty to work on, but the season should be a good one. Anyway, here are a few of the pictures I took inside the Big House. Go Utes!!!

Going to the Big House

I know it has been a really long time since I posted, but alas, I have been busy. Now I have a couple of small projects that are "no rush" so I can't bring myself to work on them. I was told by one of the people I work for that I should get everything done today so that tomorrow we can have fun. As you may have heard, the state is going to four ten-hour days soon. Many people are already starting the process. As a result there won't be many people here tomorrow, so we will probably go do something fun. Probably see a movie, because that is easy. I wish I worked for a big firm and we could golf at the Country Club, but I'll take a paid movie too.

More pictures of the trip to Mexico will come, oh and we have pics of Spence's first swim on the Fourth. I had planned on doing a post earlier, but alas, I have only just been able to take a little time. Anyway, Amanda and I went to Mexico with Doug and Heather, and Tyler and Jaime. Doug's dad is a partial owner of a house in Cabo and he allowed Doug to have the house for his week; Doug and Heather were kind enough to invite us (although this point is somewhat debatable).

We had an amazing time. The house is perfect for those of us who went. It has three bedrooms all with private bathrooms. The living area and kitchen are not huge, but plenty large for the number of people who can stay in the house. There is a pool and a patio, and it is just one house up from the beach, so that was a quick walk. The house has a new Ford Explorer, which has actually made me rethink my aversion to Ford. All in all it is a very nice house, but the best amenity can not be described. You can talk about it and try to describe how great it is, but until you experience it, you will never know. That amenity is (or those amenities are) Maria and Pascual. Maria is the cook and Pascual is her husband and the care-taker of the house. They are a very nice couple, who have a very good set up. Maria gets her ego stroked all the time and Pascual spends the day with his wife that he loves very much. Now my comment about Maria's ego is not to say that she is egotistical, it is a comment about how amazing her food is. There is never a meal that she prepares that is not profusely praised. Amanda's family eats at Tres Hombres thinking that it is good Mexican food (and I agreed before eating Maria's food). I told Amanda's parents that Maria's food makes eating Tres Hombres seem like eating at a Taco Bell that has been shut down for health code violations. But that still doesn't do her food justice.

Anyway, enough about Maria (although I could go on and on). We had a blast just hanging out by the pool, having my head slammed into the beach because I didn't quite jump over the large wave crashing on top of me, trying to barter with the locals, on a never-ending snorkel adventure, seeing what Costco is like when there aren't a million people in it, and many many more things. Here are some pictures, like Amanda's page, they are stolen from the others we went with. I will add more when I have internet access and time.

5 Years Later

A lot can happen in 5 years. You can get married, have a child (the best kid ever) and gain 30 lbs. At 10:20 am in the Salt Lake Temple a bawling Amanda decided to accept me as her husband, and at the same time she made me the happiest guy in the world. Even waiting for her after the ceremony (watching 3 grooms come out, wait and then have their wives meet them to go outside) was worth every second. When she walked around the corner, I was sold on buying my daughters (when they come) a nice wedding dress. If they can look half as good as their mother did on her wedding day, they will be gorgeous. In the 5 years since we have had good times and bad times (mostly poor times), but I haven't regretted my decision for one second.

I know this is cheesy, but hey, I forgot to mention Amanda when I spoke at our wedding dinner, so here goes. Amanda, I love you and always will. Thanks for settling on me and putting up with all that I have put you through. When we are apart, I can't wait to see you again. When we are together I can't get enough. You are my best friend, and there is no one I would ever rather be with. Thanks for all you do for me, and I hope the future is half as happy for you as the past 5 years have been for me. I love you,

Meiszus

iPod Troubles

So this morning I was running a little late going out to get on the bus. But first I had to drop off our rent check. As a result of my short detour, when I got to the entrance to our parking lot I saw the bus waiting at a red light. Startled, I started running to make sure I could cross the street, but alas, my ipod was in my shirt pocket, and as a result of my running it escaped, crashing to the ground at my feet. Pissed, I picked up the scratched machine and hurried along to the bus (of course the light took forever to change and I would have had plenty of time had I just walked).

Anyway, because I had run I had a minute to start my ipod before the bus got there. I had been listening to Foo Fighters, but I decided it was time for something else, so I tried to listen to Glen Phillips, but when I hit the select button nothing happened. Well the bus came and I got on, still with no music. As I showed Amanda a few months ago, there is a simple way to reset your ipod, so I did that, but after the apple came I was hit with this...

I had never seen this before, but immediately I knew it was not something good. Stranded on the bus with no music to listen to I decided to call and make an appointment with a mac genius, but, blerg, you can only make appointments from a computer, and my computer does not get internet on the bus. So I called apple tech support only to find out to my utter dismay that accidental damage is not covered on my applecare warranty. Frick, double frick!!!

Well, when I got to work I started troubleshooting to figure out if there was anything I could do to fix it. But there appeared to be nothing that could be done. Now that I had internet access, however, I decided to set up an appointment at the genius bar and see if they could help me. Luckily I was able to get in fairly quickly, so I headed down to Gateway to try and resolve the issues.

Of course I didn't want to tell the genius that I had dropped my ipod and that is why it doesn't work, but I wasn't going to lie to him and say that I hadn't dropped it, so I just answered his questions, very specifically. He asked how I was doing and what I could do for him. I answered that other than the ipod issue I was good, and he could help me by fixing my ipod. I told him that when I had try to select music the ipod froze and so I reset it and all I could get was the picture above. He said, ok let's see what is wrong, then he put the ipod up to his ear and said, your hard drive is shot. The he asked me if I use it to work out, I replied that I do and he said you shouldn't because it will do this eventually. He typed in the serial number and found that my warranty was still active and he gave me a new ipod. Yay me! Luckily this time I have all my music backed up, but this time I will put less music on it, only music that I really want, and save some space. It seems to run better when I have less on it. Anyway, that is my scary day so far. Thanks for sharing it with me.

Gruss di.

Flaming George?

So over Memorial Day weekend Dianna and Travis invited us to go to Flaming Gorge with them to Dianna's family's cabin. It was my third time going to the cabin, but it has been a few years. It was also the first time we took a kid with us, which had us worried, because we didn't know how he would travel, it being his first trip and all. Turns out that we have the most amazing baby in the entire world. Not only has he been sleeping through the night since he was less than a month old (thanks to the schedule we have him on), but he is the best traveler. In the eight hours of travel that we did he only made any real noise twice. Both times were on the trip home. The first time was when he had a blowout, but he was just making noises in the back seat, he wasn't really fussy. The second time was when we were in Parley's and he was about an hour past his usual meal time. This time was a little more fussing, but definitely nothing to drive you crazy.

Anyway, we drove up Saturday night, after Travis got off work; then we drove home Monday afternoon. We hung out, played games, read, got ice cream at Dutch John and just enjoyed the long weekend. Thanks Nanner and Traver.

Fletch, Rattle and Hum.

2) Name a movie that you've seen multiple times in the theater. Like Amanda, because I was with her, I saw Bourne Supremacy twice. Also Batman Begins, and several others.

3) Name an actor that would make you more inclined to see a movie. I don't think there is an actor that would make me more inclined to see a movie that I otherwise would not want to see.

4) Name an actor that would make you less likely to see a movie. Drew Barrymore, I hate her.

5) Name a movie that you CAN and DO quote from. The Godfather* (leave the gun, take the cannoli) & Fletch (Can I borrow your towell for a sec, my car just hit a water buffalo?)

6) Name a movie musical that you know all of the lyrics to all of the songs. Sound of Music, but I tend to know the lyrics, unlike someone I know.

7) Name a movie you have been known to sing along with. I don't really sing along to movies; sometimes I sing to their soundtracks, but I tend to like to watch a movie, not sing to it; but maybe Rattle and Hum.

8) Name a movie that you would recommend everyone see. The Godfather*

9) Have you ever seen a movie in a drive-in? I don't recall ever having seen a movie in a drive in.

10) Name a movie that you keep meaning to see but just haven't yet gotten around to it. I don't know, there are lots of them, but whenever I am on Netflix or at the movie store I never remember what they are.

11) Ever walked out of a movie? No, never walked out of a movie in a theater, but I have at home (Amanda was watching one of the most painful movies ever, Delovely).

12) Name a movie that makes you cry. Rudy.

13) Popcorn? Yes, preferably Popsecret Homestyle

14) How often do you go to the movies (as opposed to renting them or watching them at home)? Used to go a lot, almost never go anymore

15) What's the last movie you saw in the theater? 27 Dresses (I didn't remember, but I stole this from Amanda, so that must be right).

16) What's your favorite/preferred genre of movie? Drama/Action

17) What's the first movie you remember seeing in the theater? Return of the Jedi, maybe.

18) What movie do you wish you had never seen? Lots, but especially the portions I have seen of Catwoman and Delovely.

19) What is the weirdest movie you enjoyed? Memento

20) What is the scariest movie you've seen? Alien

21) What is the funniest movie you've seen? Fletch.

22) Name new releases that are on your "to see" list: Don't know. I guess I will be seeing Dan in Real Life, and I hear it is good, so I guess that is ok.

23) Name some of your favorite movies not listed above: I really liked Casino Royale, The LOTR trilogy is good, as long as you don't watch them too frequently, original Star Wars trilogy is also very good (although Luke is a wuss), A Few Good Men, Last of the Mohicans, Crimson Tide, Die Hard, and many, many, many more.

* Although I had always intended to see it, I must admit that Amanda introduced me to The Godfather, which is definitely in my top 5 movies of all-time. I'm sure I would eventually have seen it, but I must thank her for introducing me to it.

Lawyer Commercial

So I am thinking of going into solo practice. Understand that the internet can be a scarry place, but there are a few precautions you can take. I guess one of those precautions (and the one preferred by many) is to make you blog private. I guess this works, but why would you want to do this. Yeah, you protect your family from crazies out there, but isn't there another way to do that, simply don't post too much personal information.

Anyway, as a result of this paranoia, I have deleted a number of links to blogs on my site. Apparantly they were paranoid, but didn't feel that I should be included in their privacy, so good bye. I know Amanda has also deleted at least one blog from her list because she was not invited to see it anymore. I know there are some people out there (including some of my friends) who have received really creepy messages, some about their kids. And if you want to go private, that is great, just know that if you decide not to invite me to your blog, I won't be asking for an invitation. If you do invite me, I will gladly read your blog whenever I get around to it.

As for the pussies out there. These are the people who are brave enough to leave mean comments on blogs, but scared to leave their names. How ridiculous is this? How hard is it to type your name at the bottom of the comment? I tend to be somewhat passive aggressive, unless you get me in a particular mood, but come on, if it is something you wouldn't say to another person's face, and leaving it as a comment is the only way you dare say something, at least have the balls to leave your name.

Naja, so ist das Leben.

Don't talk back to Darth Vader, he'll get ya

It's time for him to start eating cereal

So, it has been almost a month since I last posted. I figured it was time I do another post. So on Monday I took Spencer into the pediatrician for his six-month check-up. He weighs 19 lbs, and is 29.5" tall. That is 75% and 98% respectively. His head is a little small, but the doctor says it is growing great, plus his head doesn't look small, so if it was much bigger he might look like he has a big head.
So when the doctor entered the room and saw him, he said "That kid isn't 6 months!" Yeah, we get that a lot. Then he said, "So he's eating a lot of cereal, right?" To which I answered (because he told us not to feed him cereal until the doctor had told us it was ok) "No he is just on formula." He responded, "It's time for him to start eating cereal."
After the doctor left, the nurse came back in to give the shots. One oral vaccine and three shots, but they were out of one of the shots, so Amanda will have to take him back in this week. He took the shots well (in part because our nurse is so good at giving them) he jumped when the first needle went in, then started crying for the second one, but only cried for about 20-30 seconds. He's tough, just like his dad.
Anyway, I will try to be better about posting more frequently, but the interesting things that happen in my life are usually posted on Amanda's blog.

Servus.

An airing of grievances . . .

Although I should really be working on my moot court brief which is due Wednesday at 4:00 pm, I thought I would take a few minutes to do another post, an airing of grievances.

1. I hate when I spend several hours (time I could have been working on my moot court brief) at work researching an issue for an hearing, only to have the judge request a conference call the day before the scheduled hearing, and inform the attorney that the hearing has been postponed more than two months (April 29). It just would have been nice to not spend much of my weekend work time researching for a memo instead of researching for a brief.

2. I hate the parking personnel at the U. Luckily this year I have had no problems with them because I take the bus every day, but it doesn’t change my hatred for them. In fact, I hate them so much that I look for ways to piss them off. For example, yesterday, on my way back into the law school I was passing the pay stalls and happened to see that one of the meters had run out, and I also saw a parking Nazi heading in that direction. So what did I do? I dropped a quarter into the meter, much to the chagrin of the biking meter maid. Obviously had it been my car it would not have been an issue, but when he saw me keep walking he asked, “Is that your car?” Happily I replied that it was not. He said, “You can’t put money in other people’s meters.” I have had a similar experience with numerous of these losers, and none of them have ever had the answer to my question of “why not?” Nothing was different today, and I continued on my way, much happier knowing that he would have to wait, or come back 20 minutes later.

3. I hate law professors who give you no indication of the format of the exam until two months into the semester when they drop a hint that the exam will be completely closed book/outline and you will be expected to know the procedural history and detailed doctrinal analysis of the topic of the course.

4. I hate that the U has not beat BYU in football or basketball in two years.

5. I hate that my weekend will be ruined by having to be at school writing my brief, while my partner finished her brief a week and a half ago. Now, I have no problem with my partner, I just wish I was that motivated.

6. I hate taxes and am not looking forward to doing the paperwork.

Why Super Bowl XLII was so disappointing . . .

Don't get me wrong, I love a great game, and three lead changes in the fourth quarter qualify this as a great game, but I would have liked four lead changes. I'm not a big Pats fan, but I do like them, and I hate the Giants. Here is why I am so disappointed with the outcome of Super Bowl XLII:

I would have loved to see history made. Yeah brothers played in, won and were named MVPs of consecutive Super Bowls, which is history, but I am talking 19-0. An undefeated season in an era of free agency and salary caps, that would have been a real accomplishment. As for those of you who didn't want the Pats to get the undefeated season, there is simply one reason for this...jealousy. You are just jealous that your team didn't have a chance.

I don't really care for Bill Belichick (come on you are a professional coach, dress like one) but I don't hate him like I do Tom Coughlin. He is a jackass that even his own players hate.

Good for Eli, but why should I show him any love when he didn't show me any during fantasy football. It wasn't until I gave up hope on Eli and benched him that I finally started winning games and made the playoffs. I don't feel bad for Eli having to play in the shadow of big brother Peyton. Everyone is always saying how much better Peyton is and how Eli will never compare, well congratulations Eli, you won a Super Bowl. That is as close to the accomplishments of your brother that you will ever get.

Tom Brady deserved the win. Well not based on his performance from last night, which really is all that matters, but he demolished the league and numerous records in the process. If the Pats were to end the season with one loss I would have preferred it during the regular season.

On a side note, the commercials sucked!

Why, you may be asking yourself, do I like the Pats. Well, Amanda and I discussed this last night, and I came to a realization that my fondness for the Pats and my hatred of the Giants both stem from my love for the Niners.

First of all, my hatred of the Giants began one Sunday afternoon in 1991. LT (the original, although I like the new one better, he doesn't seem to do as much cocaine) came around the corner and blindsided Joe Montana, injuring him. As a result of the fact that the Niners were winning the game (and it looked like going to their third Super Bowl in a row) Steve Young was instructed to hand the ball off to one of the most reliable running backs in history, the reason I love the Niners, Roger Craig. Wouldn't you know it, Roger caughs the ball up and the Giants end up winning the game on a last second fieldgoal, 15-13. Thus began my hatred.

As for the Pats, it is not so direct, but it is much shorter. In 2002 the Pats played the St. Louis Rams in the Super Bowl. The Rams are in the same division as the Niners, so I wanted the underdog team to defeat the team from the Niners' division.

Anyway, it was a great game, but I didn't care for the outcome.

Happy Birthday, Amanda!

I know, I need to post more often, but I haven't had anything interesting to post, so I figured I wouldn't bore the few people who read this blog.

Anyway, today is Amanda's 28th birthday. Happy Birthday! We don't have too much planned for this evening, but on Saturday we are going to dinner with a few friends (assuming I actually make the reservations). And I haven't been a great husband this year, because I still haven't finished getting her birthday present, and the part that I have gotten has not yet arrived. I know, I suck, but hey, I am a busy person, and I don't have a car.

Our lives are pretty good right now though. We have an amazing baby, who sleeps through the night almost without exception (and has done so since he was just a couple of weeks old). We have a great apartment that we love. We no longer have a car payment. And Amanda and I are still best friends who are very much in love and who want to spend as much time as possible together. Overall I can't complain, I just hope she doesn't complain about a lame birthday.

Merry Christmas!

Well, I am now winding down the work-week here at the Attorney General’s Office. It’s been kind of a busy week, preparing for the holiday. I really do like my job though, even though it can be boring, there are definitely some perks. I am making some great contacts and getting great experience that will help me in my career.

We sent out Christmas cards this year for the first time. The picture above is what was on the card. Amanda and I decided we didn’t want to be on the card when we can just put a picture of our kid on it. If you think you should have received a card and didn’t, sorry; we probably didn’t have your address, and we had to limit our output due to poverty. Please send us your address though, so that you may be included next year.

Anyway, I hope you all have a great Christmas and New Year. On Monday I took my Federal Income Tax final exam and it was absolutely awful. It was the worst test I have ever taken, but with the completion of that test comes the completion of the semester for me, which means, I am half-way done with law school!

School has been going pretty quickly, and I know that I should be enjoying it more than I am, but it is hard to not look forward to life after school (when I can actually earn a decent salary, and support my family) when you are so poor. Anyway, I am now trying to work a lot and earn a bit of money so that we can start next semester off with a little bit to pay things.

Well today is also the day Spencer turns 3 months old. It's kind of crazy how quickly time is flying by, but he is a lot of fun to have around. He is usually a really good kid, sleeping through the night (most of the time), and in general very good natured. He is so good that Amanda is excited to have another one (although that won't happen for a while). Anyway, better get back to work,

Frohe Weinachten

Divine Intervention (Collie's view)

So my friend Natalie, who is an avid BYU fan (as proven in the comments of the post seen below) sent me this picture. In a little less than a week I will officially be half-way done with law school. Friday I have a Business Organizations final exam, then on the following Monday I have my Federal Income Tax final. So approximately 5:00 pm on Monday I will be finished with the semester (other than a paper, but I am not counting that because it will be pretty easy).

Unfortunately the two finals I have are my two least favorite classes this semester. I think tax is extremely boring, and I have a hard time paying attention. Someone told me it was a good class to have, now I am wishing I had taken it pass/fail, but what can you do? As for Bus Orgs, I have been diligently studying this week to try and teach myself a semester's worth of material, because we didn't have a teacher who is much of a teacher. She is actually known around the school as Delores Umbridge (for those of you who are Harry Potter fans), and the name fits.

Anyway, wish me luck. 5 days to freedom.

Servus.

I didn't want to, but . . .

I had chosen not to blog about the extremely disappointing loss last weekend suffered by the Utes at the hands of the Kitties. I won't comment on the poor officiating in the last two minutes, nor on the completely bone-headed play by Bryce McCain leaving Austin Collie wide open on 4th and 18 (which handed the game to the refs to hand to the Kitties). My only comments will be in regards to BYU fans.

I have attended games in many locations and with many different teams. I have observed a few things regarding fans. Wyoming fans are vicious. Boise State fans are absolutely annoying due to extreme arrogance. Ute fans are like all other fans and think they know the game much better than they actually do. All fans are annoying when they win a big game. All fans are sore losers when they are on the losing side of a big game. But more than anything else, THERE ARE NO FANS WORSE THAN BYU FANS!!

First of all, the U's fight song, Utah Man, is somewhat Polka-ish, I can admit it, but "Rise and Shout"? To quote Gob, "COME ON!"
Second, I am a Star Wars fan, but lose the Empirial March; it just makes you look stupid.
Third, just because you go to the school owned by our Church, get off your high horse. Always remember, THE PROPHET IS A UTE! So are numerous members of the Twelve (including one who was an All-American for the Utes).

To illustrate my point about how annoying BYU fans are, last year, after we lost, I was reading the newspaper and Wayne Rout, from El Paso, Texas had submitted a comment regarding the rivalry. His comment was titled "Mormons ought not root against Y." and read, "I can't imagine how any active member could root against BYU. I can't respect any who do. I have no problem with their supporting another team for whatever reason, but there should be a clear dividing line." Sorry Wayne, but I think Elder Wirthlin might qualify as an "active member" and I think he deserves your respect. This is one problem with Y fans.

Now I know, I am a Ute fan, and we have lost two years in a row, so I am bitter. And it is a rivalry, and rivalries bring out the worst in fans. But I have been to numerous BYU games in Provo, which were not against the U. BYU fans are the most annoying, unloyal fans I have ever seen.

In closing, I love that anyone who went to BYU thinks that they are smarter than those of us who went to the U. Let me just say, I love that argument. If you think that, let's compare high school GPA's. Trust me, I didn't go to the U because I couldn't get into the Y. I chose to go to the U, inspite of my ability to get into the Y.

That will do for now. Sorry for the blow up. Thanks for letting me vent.

Froehliche Weinachten

The Best of Both Worlds

Ok, so last night Amanda and I were watching TV and started discussing a guilty pleasure of mine (well ours, but it is more guilty for me than for her), and she told me that I should blog about it, so here goes. . .

At this point, one of my biggest guilty pleasures is watching "Hannah Montana" on Disney Channel. Now before you laugh, you should really watch a few episodes, it really is pretty good. In fact, a few nights ago, while Amanda was not home, I found myself watching "Hannah Montana" for three solid hours. Oh, and last night, while we were watching it (before the Office came on) they had a new beginning (updated scenes from the show) and I had seen every episode that was on the intro.

Anyway, in other news, I turned in my rough draft for my Wrongful Convictions seminar, and last night I did my oral argument against Summary Judgment, and killed it. I thought I did ok, but my teacher really liked it, and I ended up getting 50/50 on it. Can't complain there. I don't usually like to brag, but in this case I can't help it. Yea me!

I only have one class next week, so I have almost two weeks off before I have any more school, but I only have half a week of classes left, then on to finals. Wish me luck.

Bis dann.

Two Months Later

Well Baby Spencer is now two months old. It's kind of crazy how fast time goes by, but at the same time, it seems like we have always had him with us. He is adjusting well. He sleeps through most nights (last night was not one of them), and he is almost always happy or asleep (except for when it is time to eat).

Last Saturday Amanda and I took him to his first football game. It was somewhat difficult feeding him and keeping him covered because it was such a nice day and we didn't want him to get sunburned. But he seemed to not mind all of the noise and confusion. It gave him something to look at. And to top it all off, the Utes beat Wyoming 50-0, but the game wasn't quite that far out of reach when we left. We took off at half-time, the score was 40-0. Go Utes!

As for me, this week has been a bit stressful. I am quite busy at work, and at least twice as busy at school. Today I have a rough draft of a paper due in my Wrongful Convictions Seminar (thankfully my professor is happy with anything at this stage, because I have not spent as much time on it as I would like), and tomorrow I have oral arguments in opposition to a motion for summary judgment in my Pretrial Practice class. The thing that sucks about it is we are using actual pleadings from an actual case, therefore I have to argue what the actual lawyers put in the memo. Unfortunately I got the losing side, and it is no surprise they lose, from the memo, it appears they don't understand summary judgment (something you learn in your first semester of law school). Maybe they had the same professor I had for CivPro and they slept through the entire class.

Anyway, wish me luck as the semester winds down.

Servus.

The Blessing

So Sunday we blessed Spencer. I must say I was a bit nervous, and even more so than I normally would have been. You see, Saturday I was at my parents' house while Amanda did a little shopping. Usually Spencer is very easy to deal with, if he cries you pick him up for a few minutes, then you can set him down and all is well. But when he is tired and fighting sleep, you need to pick him up, and hold him tightly, then in a few minutes he will calm down and fall asleep. Saturday was a completely different story.

He was getting tired, so I picked him up and held him close, but this seemed to infuriate him. He fought and fought and screamed his head off. I took him downstairs because it was cooler down there, and this seemed to work for a minute or two, but then again he screamed and screamed. Normally you might think he was hungry, but thanks to my mother (who is watching him during the week because Amanda and I both have to work) he is on a great eating schedule, and he had just eaten a lot, about an hour before the melt down.

Eventually my mom was able to calm him down (how inadequate do you think that made me feel?) and he was fine until we got him home. Then the melt down started all over again. Well the melt downs continued until about 2 o'clock on Sunday afternoon (our Sacrament Meeting starts at 2:50) when we put him in the car seat and drove him around for a while to calm him down. After a lap or two around the block, he was calm, at least for the moment.

It turns out, that was the last freak out he has had (until this morning when I was supposed to be sleeping). He was great during the blessing. Wide awake and happy as can be.

After the meeting we had a gathering at Amanda's parents' house (they live just up the street from us). It turned out great. Lots of people showed up and ate lots of food. We watched the Colts-Patriots game and had a good time. But alas, we forgot our camera and thus the attached pictures are after the party at our apartment. I'm sure we can get pictures from others who were there (April has an awesome camera and took at least some pictures).

That is all for now.

Servus

My Dilemma

So, for those who have not heard, I recently got a new job. I work as a law clerk for the State Agency Counsel Division of the Utah State Attorney General's Office. This means I do research and prepare memos and sometimes pleadings for the attorneys in my division. This morning I was talking to another clerk, who works in the Tax Division. He has been working here much longer than I have (since last March, I started last week). He asked me how much work I have to do, and I told him that I am very busy. He told me that in almost 9 months of working here he has been assigned only 5 projects to do. I was assigned 6 my first day! I asked him what he does to keep busy to which he replied that he reads his school work.

So therein lies my dilemma. I like having the opportunity to get very valuable experience researching and writing, not to mention creating contacts that could help me down the road, but I would like a little time to be able to do my school work as well. I have two big finals that are coming up all too quickly, not to mention an oral argument to prepare for a Motion for Summary Judgment and a presentation to prepare and paper to write about prosecutorial misconduct and how to fix the problem.

When I first heard that the other clerk has nothing but school work to do and yet he gets paid as much as I do, I was a little jealous, but then I realized that although we are getting paid the same, and he has more time to do school work, I am the one gaining much more valuable experience, which will definitely help me in the long run, even if he ends up getting better grades than I do.

Naja, so ist das Leben.

I know, I know

Due to a fear of being left behind, and the mounting pressure to keep up, I too have succumbed to the pressures and joined the blogging world.
